Pengacara perceraian di Belanda: apa yang mereka lakukan dan bagaimana cara kerjanya

A divorce in the Netherlands can only be started by a lawyer: under Article 1:150 of the Dutch Civil Code (BW) only the court can pronounce a divorce, and the district court (rechtbank) only accepts the petition if a lawyer files it. If you have minor children, a parenting plan must be filed with the petition (Article 815 of the Code of Civil Procedure, Rv). The only exception: a registered partnership without minor children can be dissolved by agreement, without a court.

Beyond that formality, the lawyer’s work consists of settling the home, the assets and debts, maintenance and pension, and recording those arrangements in a way that binds both of you afterwards.

Apa peran pengacara dalam kasus perceraian?

A peraturan keluarga lawyer handles the legal side of your divorce and files the documents with the court. In concrete terms, the lawyer:

  • Draws up the petition for divorce or dissolution of a registered partnership and files it with the district court.
  • Works out the arrangements on the home, the division of assets and debts, spousal maintenance and pension, recorded in a perjanjian penyelesaian perceraian (echtscheidingsconvenant), taking into account whether you married in community of property or under a prenuptial agreement.
  • Draws up or reviews the parenting plan: care arrangement, main residence, contact, holidays and child maintenance.
  • Asks the court for provisional measures (voorlopige voorzieningen) on housing, the children or maintenance while the divorce is pending.

Where there is an international element, such as an expat spouse, income or a home abroad, private international law also applies. The lawyer then first checks which court has jurisdiction and which law applies.

How does a divorce with a lawyer work?

You file either a joint petition or a unilateral petition with the district court. A joint petition (Article 1:154 BW) is usually decided on the papers, without a hearing. The general steps:

  1. First meeting: the lawyer reviews your situation (prenuptial agreement, registered partnership, children, debts, business).
  2. Documents: marriage certificate, birth certificates, annual income statements, the WOZ property valuation, pension statements.
  3. Arrangements: the lawyer works out the division with you, and possibly your ex-partner: household contents, bank accounts, the home, pensions.
  4. Settlement agreement and parenting plan: the lawyer drafts or reviews both.
  5. Filing: the lawyer files the petition with annexes. In a unilateral petition, your spouse usually has six weeks to file a defence.
  6. Appeal period and registration: an appeal can be lodged within three months (Article 358 Rv), unless you both sign a deed of acquiescence (akte van berusting). The lawyer then has the decision registered with the registrar of births, deaths and marriages. This must happen within six months of the decision becoming final, or the decision lapses (Article 1:163 BW); only after registration are you divorced.

Which arrangements must you make together?

At least the home, the finances, the pension and, with minor children, a parenting plan. Making them together is usually faster, cheaper and calmer:

Temacontoh
Beranda & isiPenjualan, pembelian, pembagian harta benda
Masalah keuanganBiaya pemeliharaan, hutang, tabungan
PensiunDivision of pension rights, by conversion as standard since 1 July 2022
PajakPengembalian pajak, tunjangan, asuransi kesehatan

With minor children, the parenting plan must cover at least the division of care and upbringing, how you inform and consult each other, and the costs of care and upbringing (Article 815(3) Rv). In practice it also covers the main residence, holidays and school choices.

A joint lawyer can be engaged if both of you agree. If consultation turns into conflict, the joint lawyer must withdraw and each of you needs your own.

How does ending a registered partnership differ?

With minor children, a registered partnership must be dissolved through the district court, with a lawyer, just like a divorce. Without minor children, you can dissolve it by agreement (Article 1:80c BW): both partners sign a declaration, which a lawyer or civil-law notary co-signs, and it is registered with the municipality.

The same topics arise as in a divorce: division, maintenance, pension and possible international aspects. A written settlement agreement is therefore just as important.

Lawyer, mediator or online divorce: which suits you?

It depends on how well you can agree and how complex your situation is. You need a lawyer in every case to file the petition.

  • Own lawyer: represents only your interests. Needed in complex situations or if you cannot agree.
  • Penengah: a neutral facilitator who helps you reach agreements without taking sides; a mediator can also be a lawyer. Mediation is not compulsory, but the court can refer you to a mediator (Article 818 Rv).
  • Perceraian online: suitable for straightforward joint petitions without conflict or complex assets; be careful with young children or international issues.

When do you need your own lawyer?

When you cannot rely on a shared lawyer to protect your interests. Typical situations:

  • Konflik serius atau kekerasan dalam rumah tangga
  • Kecurigaan adanya hutang atau aset tersembunyi
  • Perbedaan pendapatan yang besar antara pasangan
  • Relocation abroad, or plans to relocate with the children
  • A unilateral petition because your partner does not cooperate

Your own lawyer files documents for you alone, conducts the defence and can lodge an appeal within the three-month period.

What does a divorce lawyer cost?

Three items make up the bill, and only one is set by the lawyer. The fee depends on the hours, the complexity and whether one lawyer acts for both of you; firms quote an hourly rate or, for a straightforward joint petition, a fixed price. Ask for that basis and an estimate of hours in writing before the work starts.

The second item is the court fee (griffierecht) for the petition, set annually under the Court Fees (Civil Cases) Act (Wet griffierechten burgerlijke zaken) and published by the Rechtspraak, with reduced rates for low incomes. The third applies if you qualify for subsidised legal aid (toevoeging) from the Legal Aid Board (Raad voor Rechtsbijstand): you then pay a personal contribution that depends on your income and assets.

With a joint lawyer or mediation, you can share the costs. Lawyer’s fees for a divorce are generally not deductible for income tax.

Bagaimana jika ada hal yang tidak bisa menunggu sampai perceraian resmi disahkan?

Your lawyer can ask the court for provisional measures (Articles 821-826 Rv). A hearing usually takes place within a few weeks, and the arrangements apply until the divorce is registered. The court can decide on:

  • Penggunaan sementara rumah perkawinan
  • Nafkah anak atau nafkah pasangan sementara
  • The children’s temporary residence and contact with the other parent

What makes an international divorce complex?

Several sets of rules apply at once. Jurisdiction within the EU follows Regulation (EU) 2019/1111 (Brussels II ter), while property, maintenance and child abduction each have their own instruments.

  • Which court has jurisdiction: the Netherlands or another country?
  • Which law applies to the matrimonial property, maintenance and the children?
  • How is a business or stock option plan valued, and what are the tax consequences?
  • Is there a risk of child abduction when one parent wants to move abroad (1980 Hague Child Abduction Convention)?

Pertanyaan yang sering diajukan

Berapa lama biasanya proses perceraian dengan bantuan pengacara?

With a joint petition, a divorce is often arranged within two to four months, including registration, especially if you sign a deed of acquiescence. A contested divorce with two lawyers, a defence period of six weeks and a hearing usually takes many months, and longer if an appeal follows.

Bisakah saya mengganti pengacara selama proses perceraian?

Yes, you may always change lawyers in the Netherlands. The new lawyer requests the file from the previous one and takes over the case, which involves extra time and costs.

Apakah pengacara diperlukan untuk membubarkan kemitraan terdaftar tanpa anak?

No. Without minor children, a registered partnership can be dissolved by agreement under Article 1:80c BW, with a declaration signed by both partners and a lawyer or civil-law notary. Legal review remains advisable for the division of assets, maintenance and pension.

Bagaimana jika mantan pasangan saya tidak kooperatif atau tidak dapat ditemukan?

A partner who refuses to cooperate cannot block a divorce: your lawyer files a unilateral petition. If your ex-partner cannot be found, the petition can be served by publication in the Dutch Government Gazette (Staatscourant) or another permitted method.
